On November 8th, 2016 Massachusetts voters turned out to the polls, passing legislation to legalize the recreational use of marijuana. While it is now legal to purchase cannabis from dispensaries and consume the drug in private, the law is still confusing – especially for employers. Drugs and alcohol are a tricky territory for businesses and organizations and questions about the topic from employees and employers are endless: Can I randomly drug test my employees?  Can I fire someone for using prescription medication?  Can I fire someone who appears under the influence at work?  These questions have been complicated further by the recent passage of legislation legalizing marijuana in Massachusetts.
